هدف: ضرورت حکومت در جامعه در هر دوره، امری نیست که شخص، گروه یا صاحب ملکی آن را انکار کند. بنابراین، با این اندیشه، چه تصویری از حکومت و احکام آن در دوره غیبت می تواند وجود داشته باشد؟
روش: برای پرداختن به این مسئله، بحث سلطان عادل و ظالم که در عصر سید، اندیشه ای مسلط محسوب می شد، به عنوان چارچوب نظری مطرح است. سید مرتضی، سنت فقهی جدیدی در تعامل با نظام سلطانی بنیان گذاری کرده است که از آن می توان با عنوان « فقه السلطانی» یاد کرد.
