چکیده:
موضوع تبعیت وعدم تبعیت احکام از مصالح و مفاسد،یکی از موضوعات مهم در اصولفقه است که پذیرش و عدم پذیرش آن نتایج و پیامدهای زیادی دارد. باتوجه به مبانی مباحث اصولفقه میتوان یاد آور شد که اگر احکام شرعی را تابع مصالح و مفاسد ندانیم، باید نسبت به بسیاری از مباحث آن تجدید نظرکنیم.هدف این پژوهش، بررسی نظریات و دیدگاهها، طرح ادله و استدلالاتی در این زمینه است که از سوی قائلین به آناقوالمطرحگردیدهاند.نگارنده خواستهاست که از این طریق تا آنجاییکه ظرفیت و توان اقتضا مینماید، پاسخی برای این سوال دریابد که آیا احکام شرعی تابع مصالح و مفاسد واقعی میباشند و یاخیر؟ هدف پژوهش از همین پرسش آغاز شده ودرادامه،دیدگاه منسوب به اشاعره و دلایلآن و درمقابل دیدگاه مشهور عدلیه و ادلهی آن بیان شدهاست؛ اشاعره تبعیت را انکار نموده و برای افعال حسن و قیح ذاتی قائل نیستند.برعکس مشهور عدلیه احکام شرعی را تابع مصالح و مفاسد میدانند و به حسن و قبح عقلی قائل هستند. درمیان عدلیه جمعِ از علماء در برابر دیدگاه مشهور، عمومیت مصالح و مفاسد موجود در متعلق احکام را نپذیرفته و معتقدند که گاهی ملاک در نفس جعل و حکم است.روشنگارش این پژوهش، به صورت تحلیلی در منابعِ مختلف میباشند؛ رجوع به منابع تحقیقی، اعم از کتابخانه ای، سایتهای تخصصی اینترنتی و رجوع به مقالات معتبر، مورد توجه قرار گرفته است.یافتههای این پژوهش نشان میدهد که تمام احکام فقهی، بدون استثنا تابع مصالح و مفاسد واقعی و نفسالامریاند، چون از یک طرف دلایلی دیدگاه انکار تبعیت رد شده و از طرف دیگر در اینکه ترجیح بلامرجح محال است و استثنا پذیر هم نیست، فلاسفه به طور قاطع از این قاعده دفاع کرده و آن را امری مسلّم و قطعی میدانند. برعلاوه ظواهر آیات زیادی نیز بیانگر تبعیت احکام از مصالح ومفاسد واقعی است.
The issue of compliance and non-compliance of the rulings from benefits and corruptions is one of the important issues in Usul Fiqh, the acceptance and non-acceptance of which has many results and consequences. According to the basics of Usul Fiqh, it can be remembered that if we do not consider Shari'a rulings to be subject to interests and corruptions, we should reconsider many of its topics.The purpose of this research is to examine the ideas and views, to present evidences and arguments in this field, which have been presented by those who believe in Anaqavalam. The author wants to find an answer to the question of whether Shari'a rulings are subject to interests and Are corruptions real or not? The purpose of the research started from this question and in the continuation, the view attributed to Ash'ari and its reasons and against the famous view of Adliyya and its reasons are stated; The Ash'arites deny obedience and do not consider good and evil actions to be intrinsic. On the contrary, the well-known legal scholars consider Shari'a rulings to be subject to interests and evils, and they consider goodness and badness to be rational. Among the judiciary, a group of scholars, against the popular opinion, did not accept the generality of interests and corruptions in the property of rulings and believe that sometimes the criterion is in the nature of forgery and rulings.The clarification of this research is analytical in different sources; Reference to research sources, such as a library, specialized internet sites, and reference to authoritative articles, have been considered.The findings of this research show that all jurisprudence rulings, without exception, are subject to real interests and corruptions, because on the one hand, the view of denying compliance has been rejected for some reasons, and on the other hand, in the fact that absolute preference is impossible and cannot be excluded, philosophers firmly They defend this rule and consider it as a definite and definite thing. In addition, the appearances of many verses also show that the rulings are based on real benefits and harms.
