چکیده:
دیوان بینالمللی دادگستری، نهاد حلوفصل اختلافات میان دولتها، در راستای وظیفه خود در شرایطی خاص بنا به درخواست هر طرف اقدام به صدور دستور موقت مینماید.دیوان نیز بهتبع اهمیت حقوق بشر در نزد افکار عمومی و جامعه جهانی، در راستای ایفای وظیفه خود به تأسی از منشور ملل متحد، در جهت اعمال حقوق بین الملل و نیل به اهداف منشور، در موارد ضروری دستوراتی را صادر میکند. صدور دستور وتعیین اقدامات موقت بر اساس معیارهای فوریت، ضرورت، خسارت غیرقابل جبران و صلاحیت اجمالی دیوان صورت می گیرد. پرسش اصلی مقامه حاضر آنست که دیوان در صدور دستور موقت در قضیه اعمال کنوانسیون منع و مجازات نسل کشی( گامبیا علیه میانمار) در تاریخ23 ژانویه 2020 با چه نو آوری هایی صلاحیت خود را احراز کرده و چه تحولی در نوع تعهدات ناشی از دستورات موقت ناظر بر حقوق بشر ایجاد کرده است؟ دیوان با توسعه صلاحیت خود اهتمام بیشتری به موضوعات حقوق بشری ورزیده و به توسعه انسان محور شدن حقوق بین الملل کمک کرده است. با بررسی دستور موقت دیوان در این پرونده ملاحظه میشود که رویکرد دیوان در صدور دستور موقت در قلمرو حقوق بشر از جنبه احتیاطی به جنبه حمایتی تغییریافته است.
The International Court of Justice (ICJ), the institution for resolving disputes between states, issues an interim injunction in accordance with its mandate in specific circumstances at the request of each party.
