چکیده:
امروزه دولت ارائۀ خدمات عمومی را بهنحو روزافزونی گسترش داده است. نظام پرداخت الکترونیک در زمرۀ خدمات نوین عمومی است که به دلیل حساسیت و پیچیدگی نیازمند قاعدهگذاری، نظارت و کنترل نهادهای ذیربط است. شبکۀ الکترونیکی پرداخت کارت (شاپرک)، که بهمنظور ساماندهی نظام پرداخت الکترونیک کشور راهاندازی شده است، کلیۀ تراکنشها را نظارت و کنترل میکند. این شبکه با ایجاد زیرساختهای لازم، تراکنشهای برخط و آنی را پدید آورده و بستری برای تراکنشهای کارتمحور در فرایندی نظارتی و بسیار قوی با امنیت بالا در نظام مبادلات بانکی کشور فراهم آورده است. ارائۀ این خدمات، اختیارات و وظایفی برای بانک مرکزی و شاپرک ایجاب میکند که از آن جمله میتوان به تکلیف فراهمساختن زیرساختهای لازم، پرداخت کارمزد، شناسایی تخلف و اعمال جریمه اشاره کرد. این اختیارات و وظایف، بهصورت بالقوه موجب ایجاد موقعیت تعارض منافع میشود، تعارض منافعی که بهصورت بالقوه و بالفعل موجب اختلال در ارائۀ خدمات عمومی و تضییع اموال خصوصی و عمومی میشود. تحقیق حاضر، با بررسی ابعاد حقوقی تعارض منافع در صنعت پرداخت الکترونیکی ایران و مسائل موجود در این زمینه، به این نتیجه رسیده است که باید با تصویب مصوبات مرتبط با تعارض منافع در شبکۀ پرداخت کارتی، قاعدهگذار و مجری، نهاد ناظر و نهاد نظارتشونده از یکدیگر جدا شوند. همچنین باید تعارض میان درآمد و وظایف سازمانها و تعارض بین وظایف سازمانی بازیگران درگیر در این صنعت برطرف و تغییر قواعد در فرایندهای کارشناسمحور مدنظر قرار گیرد.

The electronic card payment network. created to organise the country's electronic payment system and monitors all transactions. This network creates online and instant transactions by creating the necessary infrastructure and provides a platform for card-based transactions in a robust monitoring process. Provides security in the country's banking exchange system. Providing these services requires powers and duties for the Central Bank and Shaparak, among which the responsibilities of providing the necessary infrastructure, identifying violations and imposing fines can be mentioned. These powers and duties can potentially cause a conflict of interest. Conflict of interests can potentially cause disruption in the provision of public services and damage private and public property. By examining the legal dimensions of the conflict of interest in Iran's electronic payment industry and the challenges in this field, the present research has concluded that by approving the approvals related to the conflict of interest in the card payment network, the rule-maker and the executive; The supervisor and the supervised should be separated from each other. Also, the conflict between the income and duties of organisations and between the organisational duties of actors involved in this industry should be resolved, and the rules should be changed in expert-oriented processes.
