چکیده:
در حقـوق ایـران، قانـون تجـارت الکترونیـکی ایران و قانون حقوق مصرفکنندگان، به طور خاص تعهد به اطلاعرسانی پیشقراردادی به مصرفکننده را مورد توجه قرار دادهاند. طرح قانون بیع مشترک اروپا نیز ضمن ملزم نمودن فروشندگان و تأمینکنندگان به ارائه اطلاعات به مصرفکننده، مصادیق این تعهد را به تفصیل بیان کرده است. هر چند در مصادیق ارائه اطلاعات تشابه قابل توجهی بین قوانین فوقالذکر وجود دارد، ولی قانون تجارت الکترونیکی ایران به موارد کمتری از اطلاعرسانی تصریح کرده است و برای مثال اطلاعرسانی نسبت به اصول رفتاری فروشنده یا نحوه رسیدگی به شکایات مورد تصریح قرار نگرفته است. در ضمانت اجراهای در نظر گرفتهشده، تفاوت بین دو نظام مورد بررسی بسیار است؛ به طوری که طرح قانون بیع مشترک اروپا، حمایت از مصرفکنندگان را به نحو مناسبتری تأمین میکند؛ زیرا ضمانت اجراهای متنوعی متناسب با هر تعهد در نظر گرفته است، مانند عدم لزوم پرداخت هزینههای اضافی از سوی مصرفکننده که توسط فروشنده اعلام نشده است. این مقاله که به روش توصیفی-تحلیلی انجام یافته است، تلاش میکند با بررسی قوانین مربوطه ایدههایی را به منظور اصلاح قانون و حمایت قویتر از حقوق مصرفکنندگان در مقوله تعهد به ارائه اطلاعات پیشقراردادی در ایران ارائه کند.
In Iranian law, Iranian Electronic Commerce Act and Consumer Rights Act, particularly, consider obligation to provide pre-contractual information to consumer. The proposal on a Common European Sales Law also obliges sellers and suppliers to provide information to the consumer, and defines cases of this duty in detail. Although there are significant similarities between the above-mentioned laws in the cases of information, But Iranian Electronic Commerce Act counts fewer cases and for example doesn't mention providing information about seller’s code of conduct or complaints handling policy. there is a big difference between the two systems in the remedies, in a way that Common European Sales Law provides better consumer protection, because different remedies according to obligations is determined, like as consumer is not liable to pay additional charges when seller fails to comply with information duties. This article, which is based on descriptive-analysing research method, reviewing the relevant laws, seeks to provide ideas for law amendment and stronger protection of consumer rights in Iran in the area of duty to provide pre-contractual information.
