چکیده:
تأثیر اقدامات هر یک از اصحاب دعوی بر یکدیگر صرفاً در قالب اثبات دعوی از ناحیه خواهان و در مقابل رد آن از ناحیه خوانده قابل تحلیل است .اما در دعاوی که خواهانها یا خواندگان متعددند اقدامات هر یک از خواهانها یا خواندگان متعدد علاوه بر اینکه در جهت اثبات ادعا از یک طرف یا رد آن از طرف مقابل مطرح می گردد ممکن است نسبت به سایر خواهانها یا خواندگان نیز موثر باشد که این امر برپیچیدگی دعوی نیز خواهد افزود. بصورت کلی در دعاوی مطالبه اسناد تجاری، تجزیه پذیری یا عدم تجزیه پذیری آراء صادره تابع علتی است که موجب نقض رای در حق معترض گردیده است. چنانچه این علت مشترک بین همه مسئولین سند تجاری باشد نقض رای بواسطه اعتراض یکی از مسئولین در حق دیگران موثر خواهد بود به عبارت دیگر رای غیرقابل تجزیه خواهد بود و در غیر این صورت رای قابل تجزیه خواهد بود .مسئله دیگر امکان تجزیه دعاوی مطالبه اسناد تجاری از حیث موضوع است در واقع سوال اساسی آن است که آیا می توان این دعاوی را تجزیه نمود و چنانچه نسبت به قسمتی از خواسته ،پرونده معد صدور رای باشد اتخاذ تصمیم نمود یا خیر و دیگر اینکه امکان طرح دعوای مطالبه وجه یک سند تجاری در پرونده های متعدد که در هر یک از آنها بخشی از وجه سند را مطالبه نماییم وجود دارد یا خیر ؟ بنظر می رسد تجزیه پذیری دعاوی مطالبه اسناد تجاری از حیث موضوع تابع قواعد عمومی بوده و دارای ویژگی خاصی نمی باشد .

If this is a common cause among all the officials of the commercial document, the violation of the vote due to the objection of one of the officials will be effective against the others, in other words, the vote will be indivisible and otherwise the vote will be decomposable. In terms of subject matter, in fact, the main question is whether these lawsuits can be decomposed and if a case is decided on a part of the request for a vote or not, and the possibility of filing a lawsuit to claim a commercial document in the case. Are there several cases in each of which we demand a part of the document? It seems that the separability of claims for commercial documents is subject to general rules in terms of subject matter and does not have a special feature.
