چکیده:
چکیده زمنیه و هدف: مفهوم "تحت نظر" و حقوق فردی که در این شرایط قرار میگیرد، در ارتباط وی با پلیس است که تداعی میگردد. با عنایت به توسعه نظام حقوق کیفری هند در سالیان اخیر و اصلاحات گسترده و ضد فساد در مورد کارکرد مقامات پلیس از باب ارتقا و صیانت از حقوق متهمین، با بررسی قوانین و آرای دادگاهها توامان در دو باب نص و رویه، در این مقاله حقوق فرد در زمان تحت نظر مورد واکاوی قرار گرفت که با توجه به شناسایی این مفهوم در حقوق ایران برانیم تا با استفاده از تجربه هند به صیانت هر چه بیشتر از حقوق متهم و بهبود نظام کیفری ایران دست یابیم. روش: نوشتار حاضر با روش توصیفی –تحلیلی و با تکیه بر ارای قضایی تقریر یافته استیافتهها و نتایج: مقاله حاضر در پی پاسخ به این پرسش است که شناسایی و تضمین حقوق فرد تحت نظر در نظام کیفری هند چگونه بوده است و نظام قضائی این کشور چه عملکردی داشته است؟ یافتههای پژوهش این میباشد که حقهای متهم تحت نظر به طرز مناسبی در قوانین جزایی و اساسی این کشور شناسایی شده است و قوه قضاییه در هند با تکیه بر احکام مبتنی بر تفسیر موسع از قوانین و به نفع متهم، خلاهای ناشی از نقض و اجمال قوانین را برطرف و بدین طریق از حقوق متهم تحت نظر صیانت نموده است که در زمنیه ضمانت اجرا نقض حقوق متهم نسبت به ایران دارای برتری است.
