چکیده:
درد جاودانگی ریشه در فطرت بشر دارد. از دیرباز آدمیان هیچگاه دوست نداشتند در پرانتز بین تولد تا مرگ محصور باشند. بیگمان فرزندآوری یکی از راه های درمان این درد و ارضای احساس عدم مرگ و محدود بودن بوده است. ایرانیان باستان نیز بر این نیاز جامه متافیزیکی پوشانیدهاند. به باور آنان، کسی که فرزند ندارد حیاتش به قبل از پل چینوت محدود می شود و بی فرزند نمی تواند از پل درگذرد و خلود یابد. ازینرو قوانین ارث بازماندگان در راستای پذیرش فرزندی و فرزند خواندگی اهمیت بسیار یافته است.این مقاله به بررسی قوانین فرزند آوری، فرزند خواندگی، پل گذاری و سهم الارث بازماندگان در سنت زرتشتی می پردازد و متون کهن مزداپرستان را می کاود و همچنین آنها را با احوال شخصیه زرتشتیان در حقوق مدنی ایران معاصر مقایسه می کند. این مقایسه تغییرات بسیاری را نشان داده، عوامل تغییرات را بررسی می کند.کلید واژه ها: ارث در دین زرتشتی، اهمیت فرزند آوری، فرزند خواندگی، خانواده در ایران باستان، حقوق مدنی زرتشتی
The desire for immortality is rooted in human nature. For a long time, people never liked to be enclosed in parentheses between birth and death. Undoubtedly, having children has been one of the ways to cure this pain and satisfy the feeling of not dying and being limited. The ancient Iranians also covered this need with metaphysical clothing. According to them, a person who has no children has a limited life before the Chinvat Bridge and cannot cross the bridge and become immortal. For this reason, survivors' inheritance laws have become very important with the aim of accepting children and adoption.This article examines the laws of childbearing, laws of Foster child and adopted child, and also the share of inheritance of survivors in the Zoroastrian tradition, and searches ancient Zoroastrian texts, as well as compares them with the personal status of Zoroastrians in contemporary Iranian civil law.
