چکیده:
علیرغم تعیین مجازات حدی برای ارتکاب جرم مصرف مسکر و سیاست کیفری سختگیرانه در قبال ارتکاب این جرم، لیکن نمیتوان از دو حقیقت در رابطه با مشروبات الکلی به سادگی عبور کرد؛ آمارهای رسمی و غیررسمی موجود، حکایت از افزایش روز افزون مصرف الکل در جامعه دارد و از طرف دیگر، شکلگیری اقتصاد زیر زمینی و متعاقباً شیوع مشروبات تقلبی موجب شده تا آسیبهای جسمانی شدیدی از جمله مرگ و از دست دادن اعضای بدن، متوجه مصرفکنندگان این نوع مشروبات الکلی گردد. بر این اساس، سؤال پژوهش پیشرو این است که آیا حکومت اسلامی در صیانت و پاسداری از سلامت شهروندان در برابر آسیبهای ناشی از مصرف مشروبات الکلی تقلبی وظیفهای دارد؟ اگر پاسخ مثبت است، چه راهکارهایی دراینباره میتوان ارائه داد؟ تحقیق حاضر با تکیه بر برخی از ظرفیتهای موجود در فقه امامیه یعنی قواعد «دفع افسد به فاسد»، «وجوب دفع ضرر محتمل» و «ضرورت حفظ نظام جامعه»، به این نتیجه رسیده است که پاسداری از سلامت جانی و جسمی شهروندان وظیفه حکومت بوده و هیچ امری نمیتواند در تزاحم با این وظیفه قرار گیرد. بدین لحاظ، دولت بدون جرمزدایی از مصرف مشروبات الکلی، میتواند خدمات سنجش سلامت الکل برای تشخیص مشروبات الکلی تقلبی از غیرتقلبی را به منظور جلوگیری از پیامدهای غالباً جبران ناپذیر آن، در اختیار شهروندان قرار دهد؛ امر مهمی که به هیچ عنوان به معنای تأیید رفتار مجرمانه مرتکبین مصرف الکل نیست.
One of the crimes in Shiite criminal jurisprudence is the crime of "Appearance of drunken non-Muslims in the streets and public places". The crime in question, for the first time, has entered the Iranian legal system with the approval of the Islamic Penal Code in 1392. However, the law is silent on describing the circumstances of the crime. According to the findings of the study, "drunken" is the strong and overt drunkenness. Also, this crime is committed only by the appearance of non-Muslims in public places and passages; Therefore, there is no need to be seen by another. Apart from this, the legislator has chosen the punishment of ta'zir for this crime, contrary to the popular opinion that the punishment is Had. This deliberate deviation from the Had punishment and the adoption of an infamous fatwa in this regard and some other articles in the field of Hudud, is due to the use of the "policy of reducing the implementation of Had punishments." At the same time, the legislature, within the framework of the fourth principle of the constitution and the acceptance of the realities of the contemporary world, seeks to reduce the implementation of Hudud.
