چکیده:
قوانین ایران در موارد بسیاری از جمله دادگاههایخانواده، شوراهایحلاختلاف و دعاویتصرف، با اشاره مبهم به عدم رعایت تشریفاتدادرسی، بدون آنکه محدوده رعایت نکردن آنها را معین نمایند، سبب تشتت رویه دادگاهها شدهاند. در این زمینه تعاریف حقوقدانان از «تشریفاتدادرسی» تا حد زیادی متعارض میباشد و در تبیین مصادیق آن، اختلافنظر قابل توجهی وجود دارد. این اختلاف در مواردی از جمله دادخواست، ابلاغ، هزینهدادرسی و مواعد قانونی تا آنجاست که برخی، آنهارا جزو اصولدادرسی دانسته و برخی دیگر در زمره تشریفاتدادرسی جای میدهند. بنابراین در تمییز اقسام تشریفاتدادرسی، باید آنرا به درستی تفکیک نمود؛ نوع اول «تشریفاتاساسی» میباشد که خود از دو قسم تشکیل میشود؛ قسم نخست از جمله ابلاغ و جلسهدادرسی «تشریفاتمقدمه اجرای اصول» است که امکان عدول از آن حتی با تصریح قانونگذار میسر نمیباشد. قسم دیگر از جمله دادخواست و هزینهدادرسی «تشریفات رکنیدادرسی» میباشند که با تصریح موردی قانونگذار در دادرسیهایخاص، قابل عدول میباشند. نوع دوم تشریفاتدادرسی با درجه تاثیر ضعیفتر «تشریفات ساده» میباشد که شامل مصادیق بسیاری از جمله نحوه ابلاغ، زمانجلسهدادرسی، مواعد و مهلتها میشود.
