چکیده:
هدف این پژوهش، واکاوی ادله فقهی بهرهگیری از شعر در نزد مذاهب فقهی پنجگانه حنفیه، مالکیه، شافعیه، حنابله و امامیه میباشد. این نوشتار با روش توصیفی و تحلیلی ضمن استقراء دیدگاههای مذاهب فقهی پنجگانه در موضوعات مربوط به حکم اولی بهرهگیری از شعر، حکم فقهی آن در حالات مختلف، حکم بهرهگیری از شعر در مسجد و در حال طواف خانه خدا و به نظم درآوردن قرآن و حکم پذیرش شهادت شاعر به بررسی ادله دیدگاههای مختلف میپردازد. بر اساس نتایج به دست آمده، اصل در حکم تکلیفی بهرهگیری از شعر، اباحه است، اما در حالات مختلف، احکام متناسب آن را به خود میگیرد. بهرهگیری از شعر در مسجد و در حالت طواف، تابع معانی و محتوای آن است. به نظم درآوردن نصوص قرآنی به اتفاق مذاهب فقهی، غیر مشروع، اما به نظم درآوردن معانی قرآن اعم از ترجمه و مفهوم تفسیری آن در نزد جمهور فقهای مذاهب، مشروع میباشد. تضمین و اقتباس از آیات قرآنی در قالب نظم شعری در نزد جمهور مذاهب فقهی - جز مالکیه در قول مشهور و برخی از فقهای سایر مذاهب – جایز است. شعر حرام، موجب عدم پذیرش شهادت میگردد.
The purpose of this research is to analyze the Fighh evidence regarding the using of poetry in 5 ilmic denominations of Hanafi, Maliki, Shafi’i, Hanbali and Imamia. This research is written with descriptive-analytical method with a review of different views of Islamic denominations in subjects conjoint with first decree on using poetry, its fighh decree in different situations, using poetry in mosque, while Tawafing Kaaba and organizing Quran and the decree on accepting the testimony of the poet.Based on the findings, the first decree on using poetry is permissibility, but in different situations it has its own decree. Using poetry in mosque and while Tawafing the Kaaba is dependent on the meaning and content. Organizing the qur’anic verses and unanimously is not permitted but organizing the meaning of Quran regardless of translation and interpretive concept is allowed according to the majority of jurists. Embodiment and adaptation of qur’anic verses in poetry format in majority of Islamic denominations (except Maliki and some of other denominations’ jurists) is allowed. Haram poetry will result to non-admissibility of testimony.
