چکیده:
اکثر فقیهان در مورد معاملات فضولی بر شخصیت فضولی تأکید نورزیده و در مورد آن اطلاق جاری کردهاند. از دیدگاه ایشان، هر فردی میتواند نقش فضولی را ایفا کند. این رویه در هر دو دیدگاه مشهور، یعنی صحت فضولی و دیدگاه نادر، یعنی بطلان فضولی، جریان دارد. مشهور در تعارض میان روایات صحت و بطلان، به تفسیرهایی از روایات بطلان پرداختهاند که بههیچوجه درخورِ دفاع نیستند. این تفاسیر بر پایۀ بیتوجهی به قیدهای روایات صحت، بنا شده و نشئتگرفته از اثبات بیچونوچرای حکم معاملات فضولی است. با دقت در عرف و سیرۀ عقلا و روایات صحت فضولی، به قیدهایی توجه مییابیم که صحت معاملۀ فضولی به آنها منوط شده است و فقدان این قیدها در مصادیق ذکرشده در روایاتی دیگر، دلیل بر بطلان آنها شده است. برایناساس، در هر دو دسته اطلاق وجود ندارد و بهتبع آن، صحیح یا باطلدانستن معاملۀ فضولی بهصورت مطلق نیز صحیح نیست. این قیدها که نشئتگرفته از شخصیت فضولی است، عبارتاند از: اُلفت میان فضولی و اصیل، امین شمردهشدن فضولی ازسوی اصیل و یکیبودن عاقد و معقودٌله. با استناد به عرف و روایاتی که در مورد صحت و بطلان معاملات فضولی وارد شدهاند، اثبات میشود که صحت و بطلان معامله به ویژگیهای خاص نشئتگرفته از شخصیت فضولی وابسته است.
The majority of jurists have not emphasized the personality of the unauthorized owner (Fuduli) in the context of transactions with unauthorized owners, and have generally applied the term without restriction. According to these jurists, anyone can play the role of the unauthorized owner (Fuduli). This approach exists within both well-known perspectives, namely the validity of the unauthorized owner, and the lesser-known view which is the rejection of the unauthorized owner. In the conflict between validity and rejection, famous juriconsults have engaged in interpretations of the rejection narratives that are in no way justifiable. These interpretations are offered on the basis of neglecting the conditions of validity narratives and stem from the groundless affirmation of the verdicts regarding transactions of unauthorized ownership. By carefully analyzing the lives and customs of intellectuals and validity narratives regarding unauthorized owners, we encounter conditions on which the validity of unauthorized ownership transactions is based. The absence of these conditions in the aforementioned examples in other narratives is considered as the reason behind their rejection. Therefore, the application does not exist in either of the categories and consequently it is not valid to consider such transactions as absolutely valid or invalid. These conditions are rooted in the unauthorized owner’s personality and include: harmony between the unauthorized owner and the genuine owner (Asil), the unauthorized owner being trusted by the genuine, and the unity of contractor and the contracted. By referring to general norms and reports regarding the validity or rejection of unauthorized ownership transactions, it is proved that the validity and rejection of transactions depend on the inherent characteristics of the unauthorized owner.

البته فقيهاني که روايت را دليلي بر صحت معاملات فضولي ميدانند، به هريک از اين ايـرادات پاسـخ داده اند: در پاسخ به ايراد اول اين گونه بيان ميشود که مخاصمۀ سيد، دلالتي بر رد معامله ندارد٤٠ و در برابر ايراد دوم نيز بيان ميشود: حبس فروشنده به سبب جبران خسارت صورت گرفته و حبس کنيز و فرزندش نيز براي دريافت قيمت آن ها بوده است ٤١ و در پايان ، اين گونه بيان ميشود که اگر قاضـي علـم بـه واقـع داشـته باشد، اشکالي ندارد که حيله را به صاحب حق بياموزد٤٢ و حتي تعليم حيله در فرضي که قاضـي علـم بـه ٤٣ واقع نداشته باشد نيز جايز است .
