چکیده:
«پولشویی» به نقل و انتقالهای متقلبانهای اطلاق میشود که درآمدهای نامشروع و غیرقانونی را مشروع جلوه داده تا از کشف و مصادره محفوظ بماند. گستره جرایم این پدیدهی پیچیده و سازمانیافته ـ معمولاً ـ ملی و بینالمللی است که آثار منفی در ابعاد گوناگون جامعه بههمراه دارد. حکومت اسلامی در راستای تربیت اقتصادی جامعه نیازمند اقدامات ویژهای برای مبارزه با این جرم در سطح ملی، منطقهای و بینالمللی است. این پژوهش، به روش توصیفی ـ تحلیلی، وظیفهمندی حکومت اسلامی را زدودن آثار، آسیبها و تبعات منفی پولشویی در راستای تربیت اقتصادی جامعه دنبال میکند. از آنجایی که پولشویی منجر به انتفاع از درآمدهای نامشروع میشود و آثار و آسیبهای اقتصادی، اجتماعی، سیاسی و امنیتی زیادی را در جامعه اسلامی برجای میگذارد؛ این پژوهش با استناد و استشهاد به مقتضای ادله و قواعد عامه: «لاضرر»، «ضرورت حفظ نظام»، «حرمت اختلال نظام»، مقتضای مفاد عهدنامه مالک اشتر، مقتضای روایت مستفیضه «کُلُّکُم راعٍ و کُلُّکُم مَسؤولٌ عَن رَعِیَّتِه» و نیز ادله عقلی و نقلی ـ کتاب و سنت ـ، همچنین سیره عقلا و متشرعه و اصل ضمان ید متعاقبه بر وظیفهمندی الزامی حکومت اسلامی در راستای تربیت اقتصادی جامعه بر مقابله همهجانبه با مظاهر و مصادیق پولشویی تأکید دارد.
Money laundering refers to fraudulent transfers that legitimize proceeds of crime and legitimize them and thus keep them from being discovered and confiscated. This phenomenon, which has been considered by criminologists following the spread of organized crime, especially transnationally and internationally, has negative and worrying effects. In order to educate the society, the Islamic government needs to take special measures to fight this new crime at the international and regional levels; Therefore, in Iran's criminal policy, appropriate measures have been considered to combat this phenomenon. This descriptive-analytical study follows the duty of the Islamic government to eliminate the effects, harms and negative consequences of money laundering in the direction of economic education of society. Whereas money laundering leads to the exploitation of illicit income and has many economic, social, political and security effects and harms in Islamic society; This study cites the need for public evidence and rules (prohibition of false property), (ta'zir for all Muharram deeds) and (ta'zir with us the way of the ruler) and also argues with religious teachings - the Qur'an and Sunnah - on the obligatory duty of the Islamic government and ruler in the struggle Emphasizes the manifestations and examples of money laundering.
